The types of information that we collect fall under two general categories: personally identifiable information (PII) and non-personally identifiable information (non-PII). PII consists of any information which can be used to specifically identify you as an individual, whereas non-PII consists of aggregate information or any information that does not reveal your identity. 2.1. Log Files. Any time you visit any of our websites, our servers automatically gather information from your browser (such as your IP addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks) to analyze trends, administer the site, prevent fraud, track visitor movement in the aggregate, and gather broad demographic information. For example, we may log your IP address for system administration purposes. IP addresses are logged to track a user’s session. This gives us an idea of which parts of our site users are visiting. We do not share the log files externally.
2.2. Cookies. We use “cookies” to keep track of some types of information while you are visiting our website or using our services. Cookies are very small files placed on your computer, and they allow us to count the number of visitors to our website and distinguish repeat visitors from new visitors. They also allow us to save user preferences and track user trends. 2.3. Web Beacons. “Web beacons” (also known as “clear gifs” and “pixel tags”) are small transparent graphic images that are often used in conjunction with cookies in order to further personalize our website for our users and to collect a limited set of information about our visitors. We may also use web beacons in email communications in order to understand the behavior of our customers. We do not link the web beacons to any PII.
2.4. Information About You and your clients. When you register or subscribe to any of our services, we collect a wide variety of information about you. Any information provided by yourself or your clients in any forms, questionnaires, food diaries, or record sheets will be strictly confidential and only shared with you and the client concerned. For content on your public profile, we may display your information to other community members and visitors. You may choose to provide us with your photo(s) or video(s) and by providing us such content, you agree that we may make them available to users of PTDistinction.com services. Except as otherwise stated in this privacy statement, we do not disclose your PII to other users of our services.
2.5. Purchase Information. To process purchases, we may require your name, address, phone number, email address and credit card information. Such information is used primarily to process your order or as otherwise described herein.
2.6. E-mails and Telephone Calls. We require an e-mail address from you when you register for our services. We use your e-mail for both transactional and promotional (e.g., newsletters, new product offerings, special discounts, event notifications, special third-party offers) purposes. E-mail messages we send you may contain code that enables our database to track your usage of the e-mails, including whether the e-mail was opened and what links (if any) were clicked. We reserve the right to send you certain communications relating to the PTDistinction.com services, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them. We may also contact you by telephone or text message (including to any wireless number you may provide to us) solely in connection with PTDistinction.com’s services. If you would rather not receive telephone calls or text messages from us, you may change or delete your number from your account profile page(s), or ask to be removed from our contact list if you receive a call or text message from us. We fully comply with the requirements of the U.S. CAN-SPAM Act.
2.7. Demographic Data. Demographic data is also collected at our site. We use this data to tailor our visitors’ experience at our site, showing them content that we think they might be interested in, and displaying the content according to their preferences. Some of this information may be shared with advertisers on a non-personally identifiable basis.
2.8. Online Survey Data. We may periodically conduct voluntary member surveys. We encourage our members to participate in such surveys because they provide us with important information regarding the improvement of our services. You may also volunteer for certain surveys that we may offer to our users, and any additional rules regarding the conduct of such surveys will be disclosed to you prior to your participation. We do not link the survey responses to any PII, and all responses are anonymous.
2.9. Use for Research. In addition to the uses outlined above, by using our site, you agree to allow us to anonymously use the information from you and your experiences to continue our research into successful exercise programming. This research, conducted by fitness professionals and healthcare research scientists, may be published in academic journals. However, all of your responses will be kept anonymous, and no PII will be published.
3.1 Disclosure By Law. You acknowledge and agree that we may disclose information you provide if required to do so by law, at the request of a third party, or if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law); (2) protect or defend PTDistinction.com's, or a third party’s, rights or property; or (3) protect someone’s health or safety.
3.2 Disclosure to Trusted Third Parties at Your Request. While visiting our site, we may provide you with advertisements, promotions, and offers from third party providers. If you choose to accept any such offers, you may either (depending on the situation) directly provide your information in connection with the offer to such third party provider, or we will provide your information, including billing information, to the third party provider by pre-populating the offer registration forms. Your information will not be transferred until you actually accept the offer. You may opt-out of the offer at any time up until this point. Please refer to the third party provider’s own privacy policy (provided on the offer pages) if you have any questions regarding how your information is used by such providers.
3.3 Information Transferred As a Result of Sale of Business. As we develop our business, we may buy or sell assets and, depending on the transaction, your PII may be one of the transferred assets. In the event that we are acquired by another company, your PII may be part of the assets transferred to the acquiring party. If this occurs, you will be notified if there are any material changes to the way your PII is collected or used.
4.1 We understand that PT Distinction may be used to store health, fitness and other information that may be considered sensitive personal data under applicable data protection laws.
4.2 We implement appropriate technical and organisational measures to protect this information against unauthorised access, disclosure, alteration and destruction. These measures include, where appropriate:- Encryption of data in transit using industry standard TLS;
- Strict access controls and authentication requirements for our systems;
- Role-based access to production systems;
- Regular security updates, vulnerability management and security testing;
- Secure backup and disaster recovery procedures.
4.3 Access to sensitive customer data is limited to authorised personnel who require access to perform their duties.
4.4 We continually review and improve our security measures to help protect the confidentiality, integrity and availability of personal data.
5.1 We retain personal data only for as long as necessary to provide our Services, fulfil our contractual obligations, comply with legal obligations, resolve disputes and enforce our agreements.
5.2 Cancelling a subscription does not automatically delete your account or the personal data associated with it. We may retain your account and its data so that you can reactivate your subscription and continue using the Services at a later date.
5.3 If you wish to permanently delete your account and associated personal data, you may contact us using the contact details provided in this Privacy Policy. Upon receiving such a request, we will securely delete or anonymise your personal data within a reasonable period, unless we are required by law to retain certain information for legal, regulatory or legitimate business purposes.
5.4 Backup copies may remain in secure backup systems for a limited period before being automatically overwritten in accordance with our backup retention procedures.
6.1 If you choose to connect your Google account to PT Distinction, we access only the Google data necessary to provide the functionality you have requested.
6.2 Google user data is used solely to provide and improve the requested features of the service. We do not use Google user data for advertising purposes or sell Google user data to third parties.
6.3 Google user data is retained only for as long as it is necessary to provide the connected functionality or until your PT Distinction account is permanently deleted.
6.4 When user data is no longer required as stated in 6.3, we will delete or securely anonymise Google user data within a reasonable period, except where we are required by law to retain certain information.
6.5 We do not use data obtained from Google Workspace APIs to develop, improve or train generalised artificial intelligence (AI) or machine learning (ML) models.
6.6 PT Distinction complies with the Google API Services User Data Policy, including the Limited Use requirements where applicable.
6.7 You may request deletion of your Google user data at any time by contacting us.
7.1 Where PT Distinction provides AI-assisted features, these are intended to support users and do not replace professional judgement.
7.2 Where PT Distinction utilises third-party AI services, personally identifiable information is not transmitted to those AI providers. Information shared with third-party AI models is limited to the minimum necessary to provide the requested functionality and is processed in a manner intended to prevent the identification of individual users or clients.
7.3 Unless explicitly stated otherwise, personal data submitted to PT Distinction is not used to train publicly available or general-purpose AI models.
8.1 We are not responsible for the privacy practices or the content of other websites that may be linked to this site or of any third party advertisers.
